Should Trayvon Martin's Mother Have Filed a Trademark Application ...

This is an interesting way, by the grieving family, to preserve the memories of Trayvon Martin (RIP), the 17year old unarmed black kid shot by an overzealous self designated neighborhood watchdog, George Zimmerman (White &/Hispanic). Abovethelaw.com debates the issue:

?The shooting has picked up national attention, and it?s shedding yet another ugly spotlight on race relations in America. I?m on the same page as Elie regarding most of his frustration. But earlier this week we learned that the slain teen?s mother had filed a trademark application for ?I am Trayvon? and ?Justice for Trayvon.?

Elie thinks, in a nutshell, that this is a good and proper strategy to preserve Trayvon?s memory and prevent random people from profiting off of his death. But I have to disagree. I think his family members are wasting their time and energy.

Monday News13 first reported that the

U.S. Patent and Trademark Office filings by Sybrina Fulton are for the sayings ?I am Trayvon,? and ?Justice for Trayvon.?
The applications, filed last week. A representative for Fulton says the trademarks were not filed for ?profitable purposes.?
Now, on to the debate.

The problem here is that filing a trademark application is not worth the time, or the effort, or the money for Martin?s family. I understand Fulton is concerned about people exploiting her son?s memory, and I know the intellectual property regulatory system is one official way to prevent others from doing just that. But I really don?t think anyone is going to make any significant profit off of Trayvon t-shirts. And, even if unintentionally, Fulton?s filing automatically raises questions about her motivation, regardless of whether she?s actually trying to profit from the trademarks.

Even so, the family will almost certainly not have the resources to enforce the trademark. They will not be able to do anything about Times Square street vendors ? who mostly sell copyrighted stuff anyway ? or other independent t-shirt makers. And I am pretty sure Urban Outfitters is not going to try to cash in on this.

Just because Sinbad wore a Trayvon shirt on a morning show doesn?t mean people are getting rich off of Trayvon?s name.

Moreover, t-shirt sales are a non-issue. Fulton?s application doesn?t cover apparel. The Daily Mail notes . . .?

Policy On High-Risk Biological Research Tightened

The Obama administration has announced a new policy to handle the risks posed by legitimate biological research that could, in the wrong hands, threaten the public.

The move comes in response to a huge debate over recent experiments on bird flu virus that got funding from the National Institutes of Health. Critics say the work created mutant viruses that could potentially be dangerous for people, or give terrorists a road map for making a bioweapon.

A committee that advises the government, the National Science Advisory Board for Biosecurity (NSABB), is again meeting Friday to discuss those flu studies. Late last year, it recommended keeping some details secret. But a panel of experts, including flu virologists assembled by the World Health Organization, called for full publication.

The new policy is aimed at preventing this kind of controversy from happening in the future. It covers federally funded research ? both ongoing work and future proposals. And it calls for special reviews of work that involves a list of 15 particularly nasty pathogens and toxins, including highly pathogenic bird flu virus, anthrax and Ebola.

Funding agencies will have to evaluate certain kinds of experiments to see if they pose special risks. The idea is "to really upfront ask the questions: Should they be done? And if so, under what conditions should they be done," explains Anthony Fauci, director of the National Institute of Allergy and Infectious Diseases at the NIH.

If an agency wants to fund an experiment that might yield potentially dangerous information, Fauci says, scientists could be asked to hold back on publishing details in order to receive funding.

Or, in some cases, the work might need to be classified. Fauci notes that the NIH does not do classified studies. "We would have to refer it to an agency that does classified research, because we don't," he says.

He says the NIH has already taken a look at the ongoing projects it has funded and believes very few will need more scrutiny under the new policy.

"We're not talking about a very large number of studies that are going to get looked at again and might be altered," Fauci says. "We are talking about really, really a little bit more than a handful of studies among hundreds of grants."

And so far, he says, it doesn't look like even these raise significant concerns.

The new policy was welcomed by Richard Ebright, a chemistry professor at Rutgers University who has long called for better control of biological research that could be misused.

"My first reaction was that this is an important step forward ? an overdue step, but an important one," Ebright says.

He notes that a high-profile panel of experts recommended that the government set up a comprehensive oversight system back in 2004. "It was widely expected that a policy would be developed and announced perhaps in 2004, perhaps in 2005," Ebright says. "We're seeing it now perhaps six years late."

The policy will apply to government agencies ranging from the NIH to the Department of Agriculture to the Department of Homeland Security, he notes. He thinks this policy could prevent another controversy like the one currently swirling around bird flu experiments ? but only if agencies take real action.

"If the funding agencies propose only public relations or window dressing as risk mitigation," Ebright says, "then we'll have only public relations and window dressing, and more of these problems arising."

Meanwhile, it's still unclear what will happen with the bird flu studies and the fight over how much information to make public.

The NSABB will wrap up its second meeting on this issue Friday and is expected to again offer advice on whether to publish the full details. But its recommendations are not binding on the government, the scientists or science journals.

Ron Fouchier of Erasmus Medical Center in the Netherlands, one of the scientists who did the work, spoke earlier this week on a live webcast of a science show called This Week in Virology.

"Regardless of what the U.S. government and Dutch government say, the authors and the journals are going to have the last vote on the publication issue," Fouchier said.

Carlson and Neul today announced the launch of RuralConnect, the first commercially available radio networking system to deliver the full promise of TV white space broadband to WISPs (Wireless Internet Service Providers). RuralConnect, the first product in a line co-created by the two leaders in white space technologies, follows the announcement of a global partnership in October 2011, and is aimed at bringing affordable broadband to millions around the world.

The Neul and Carlson system will give users up to 16 Mbps of bandwidth for each available vacant TV channel and unmatched ability to make long range, non-line-of-sight links. Designed specifically for the needs of wireless Internet service providers (WISPs), RuralConnect has been priced to make it immediately commercially viable. Samples and development kits are available now, with volume shipments of the new system to start as soon as Q2, 2012.

Thanks to the extension of the Payroll Tax Bill, passed in February 2012, white space radio is now fully available in the US, opening up a host of opportunities and new markets that are currently difficult to serve without expensive licensed spectrum or extensive infrastructure. This has piqued the interest of many investors and venture capitalists looking to tap in to the unlimited possibilities of this emerging technology.

RuralConnect technology, jointly developed by Neul and Carlson, uses ?white spaces,? (or unused portions of UHF spectrum), for digital communication. Due to its outstanding propagation characteristics, UHF signals can travel through walls and other obstacles: Line of sight is not needed to the subscriber?s home.

However, It is not enough just to be able to send a signal a long way. On long-range links reflections from buildings and terrain cause signals to travel via many different routes from the transmitter to the receiver. These multipath signals interfere can with each other, potential causing unreliable, slow connections. RuralConnect uses state of the art SCFDE technology to cancel the effect of multipath allowing reliable long range connections, whatever the terrain.

As a result WISPs using the new system can offer superior coverage over wide areas with limited base-station sites. It also enables the transfer of more data at higher data rates, driving additional revenue with minimal additional investment. Depending on the area, up to 20 channels are available, increasing the amount of non-line-of-sight capable spectrum available by a factor of 10.

Concurrently, Carlson is launching a line of omnidirectional and sectoral, high-gain, base-station antennas designed specifically for TV white-space broadband. The first of their kind, these antennas are powerful, affordable, and energy efficient.

Anglers are required to use circle hooks in some fishing tournaments because they are less likely to cause lethal injuries in billfish, such as marlin. However, research from North Carolina State University shows that broadening circle hook requirements could adversely impact charter and recreational fishing, since they make it more difficult to catch non-billfish.

"We wanted to know whether circle hooks are effective as conventional J hooks when angling for non-billfish such as yellowfin tuna in North Carolina waters," says Paul Rudershausen, a research assistant in NC State's biology department and lead author of a paper describing the research. The NC State team worked with charter boat captains and mates who were experienced with use of circle hooks to look at the efficacy of circle hooks versus J hooks when trolling offshore with rod and reel. The findings are relevant for similar fishing efforts in other waters where these same species occur.

A "circle hook" is defined as a circular hook in which the point of the hook is perpendicular to and aligned with the shank of the hook. This differs from a J hook, which is shaped like the letter J.

Studies have found that circle hooks are less likely to mortally wound billfish during recreational or charter fishing. As a result, the National Marine Fisheries Service instituted regulations requiring anglers in Atlantic billfish tournaments to use circle hooks when using natural baits. J hooks are still permitted if an angler is using purely artificial bait.

Anglers and fishing industry observers have speculated about the possibility that circle hook regulations may be expanded to fishing outside of billfish tournaments even when anglers are not fishing for billfish to protect billfish species that may be caught inadvertently.

This speculation led NC State researchers to determine whether circle hooks would be as effective as J hooks when fishing for non-billfish species. The answer is no.

The researchers looked at the relative effectiveness of circle and J hooks for three popular sporting fish: dolphinfish (often called mahi mahi in the Pacific), yellowfin tuna and wahoo. "Circle hooks were roughly 60 to 70 percent as effective at catching these three species as J hooks," Rudershausen says.

The researchers found that the fish would still strike at the bait, but that the hook was significantly less likely to set in the mouth of the fish. However, when the hook did set, anglers were just as likely to be able to get the fish to the boat.

"The charter ocean fishing industry is economically significant in North Carolina," Rudershausen says, "receiving approximately $65 million in for-hire fees in 2009. The concern is that circle hooks would drive down catch rates which could result in fewer clientele for North Carolina's offshore charter fishing industry."

The researchers hope to work with economists to better capture the potential economic impact of any expansion of circle hook regulations.

1.??Schedule it. Your boss needs to be available. You?ll need a private place. And plan ahead so the other person has time to think.

3.??Don?t fish for compliments. People will hold back if they doubt you want an honest assessment. Say, ?I think I may not be seen as a ?problem-solver?.? How do you think I could change that??
